Terms of Service

Last updated

These terms are an agreement between you, the parent or guardian who creates a ClimbClever family account, and [Company name]. Please read them with our Privacy Policy. By creating an account you accept them.

1. Who we are

ClimbClever is operated by [Company name], a [Legal status, e.g. private company] registered in South Africa with registration number [Registration number].

  • Physical address: [Address]
  • Postal address for legal notices: [Address for service of legal documents]
  • Email: [Contact email]
  • Telephone: [Telephone number]
  • Website: climbclever.com
  • Directors: [Director names]

2. What ClimbClever is

ClimbClever is a learning companion for South African primary-school children, aligned to the CAPS curriculum. It offers mastery practice one skill at a time, quick rounds, term exam practice, an AI tutor and a parent dashboard. Grade 4 content is available now; more grades are being added.

ClimbClever supports, but does not replace, your child's school, teachers or the official curriculum. It is not affiliated with or endorsed by the Department of Basic Education. Marks and mastery in the app are a guide to practice, not an official assessment.

3. Your account

  • You must be at least 18 years old and the parent or legal guardian of each child you add (or otherwise a competent person able to consent for them).
  • Children do not have their own accounts. They use ClimbClever through kid mode on a device you have signed in to, with a PIN.
  • Keep your password and parent PIN private. You are responsible for what happens on your account, including your children's use of it.
  • The information you give us must be accurate. You can update it at any time in the parent dashboard.

4. The AI tutor and AI marking

The tutor and sentence marking use AI. They are fenced to the skill being learned, give hints rather than answers, and refuse and flag unsafe messages. Every tutor message is saved for you to read.

AI can still make mistakes. Please check anything that looks wrong, and use the flag button: a flagged question is taken out of rotation until it has been checked. The tutor is not a substitute for a teacher, and it gives no medical, psychological or other professional advice.

To keep the tutor a helper rather than a habit, each child has a daily message limit, which we may adjust.

5. Fair use

You agree not to:

  • Share your account with people outside your family, or resell access to it.
  • Copy, scrape or republish the question bank or other content.
  • Try to get around the tutor's safety limits, the daily limits or any security measure.
  • Use ClimbClever to harass anyone or to share unlawful content.

6. Content and intellectual property

The ClimbClever software, design, Trailmates, questions we wrote and the name ClimbClever belong to [Company name] or its licensors. You may use them for your own family's learning while your account is open. Some questions are drawn from publicly available past examination papers; the rights in those papers stay with their owners.

Your children's answers and messages remain yours. You allow us to store and process them to run the service, as described in the Privacy Policy.

7. Fees

ClimbClever is free to use today, and it does not take payments. If we introduce paid plans, they will be optional, we will tell you before they start, and nothing will be charged without your express agreement. Paid plans will be governed by our Subscription terms. Points and Trailmates in the app have no money value and can never be bought, sold or exchanged.

8. Availability and changes

We work to keep ClimbClever available and accurate, but it may sometimes be unavailable for maintenance or reasons beyond our control. We may improve, change or remove features. If a change materially reduces what you have, we will tell you in advance.

9. Our responsibility to you

Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008 or other law that cannot be excluded. Within those limits, we provide ClimbClever with reasonable care and skill, but we are not liable for indirect or consequential loss, or for loss caused by events beyond our reasonable control. [Liability cap, if any, to be set after legal review.]

10. Closing your account

You can stop using ClimbClever at any time and ask us to delete your family's information, as explained in the Privacy Policy. We may suspend or close an account that seriously or repeatedly breaks these terms, after giving you notice and a chance to put things right where that is reasonable.

11. Law, disputes and changes to these terms

These terms are governed by the law of the Republic of South Africa. If you have a complaint, please contact us first at [Contact email] so we can try to resolve it. You may also have the right to approach the National Consumer Commission or a consumer court. [Court jurisdiction to be confirmed after legal review.]

If we change these terms in a way that matters, we will email you before the change takes effect and update the date at the top of this page.
