Subscription terms

Last updated

ClimbClever is free today. It does not take payments and has no paid plans yet. These terms will only apply when paid plans launch. We will tell you before that happens, and nothing will ever be charged without your express agreement.

These terms add to our Terms of Service and Privacy Policy. Where they differ on a paid plan, these terms apply.

1. Plans

  • Free plan: stays available, with these limits: [Free tier limits, e.g. number of children, subjects, Quick rounds or tutor messages].
  • Family plan: billed monthly or annually, as you choose at checkout. [Plan features]
  • Prices are shown in South African Rand before you pay, and include VAT where it applies. [VAT registration number, if registered]
  • Only the parent or guardian on the account can buy a plan. Nothing can be bought in kid mode.

2. Payment

Payments will be processed by [PayFast and/or PayPal], not by ClimbClever. You pay on their secure pages, and we never see or store your full card or bank details. Their own terms and privacy policies also apply to the payment.

3. Automatic renewal

A subscription renews automatically at the end of each monthly or annual period, at the price then in force, until you cancel. We will email you a reminder [Reminder period, e.g. 14 days] before an annual plan renews, and before the end of any fixed-term agreement as the Consumer Protection Act requires.

4. Cancelling

  • You can cancel at any time in the parent dashboard or by emailing [Contact email]. No reason is needed.
  • Cancellation takes effect at the end of the period you have already paid for. You keep paid features until then, and you are not charged again.
  • After that your account moves to the free plan. Your children's progress, history and Trailmates are kept.
  • For annual plans, the Consumer Protection Act (section 14) lets you cancel a fixed-term agreement on 20 business days' notice. If you do, we will refund the unused part of the year, less any reasonable cancellation charge the Act allows. [Cancellation charge, if any]

5. Cooling-off period

Under the Electronic Communications and Transactions Act (section 44), you may cancel a new subscription bought online within 7 days of buying it, without giving a reason and without penalty. We will refund what you paid within 30 days of your cancellation, through the same payment method.

The separate 5-business-day cooling-off right in the Consumer Protection Act (section 16) applies where a subscription results from direct marketing.

6. Refunds

  • Within the 7-day cooling-off period: a full refund.
  • Annual plans cancelled under section 14 of the Consumer Protection Act: a pro-rata refund as described above.
  • If you are charged twice, charged in error, or the service is unavailable for a long period because of a fault on our side: a refund or credit for what was affected.
  • Otherwise, monthly payments are not refunded for a partly used month, but cancelling stops the next payment.
  • Refunds go back through [PayFast and/or PayPal] to the account you paid from, within [Refund period, e.g. 10 business days] of our approving them.

7. Price changes

We may change prices. We will email you at least [Notice period, e.g. 30 days] before a new price applies to you, and it will apply only from your next renewal. If you do not want to pay the new price, you can cancel before then.

8. AI fair use

The AI tutor and AI marking have a real running cost each time they are used, so every plan includes a fair-use limit: [AI fair-use cap, e.g. tutor messages per child per day or month]. Ordinary learning stays well within it. If an account goes far beyond it, we may slow or pause AI features for that account until the next period, and we will tell you. Practice, quick rounds and exams keep working.

Your plan's monthly AI allowance is shared by all your children: [AI allowance per child per month] for each active child. You can set a monthly limit for each child in the parent dashboard, so one child does not use the whole allowance. The dashboard shows how much has been used. The allowance resets on the 1st of each month; unused allowance does not carry over.

9. Top-up credits

  • Top-up credits are extra AI credits for your family account. They are used only after your plan's monthly AI allowance for the month is used up, the oldest top-up first.
  • Each top-up lasts [Top-up validity: 24 months in this draft, to be confirmed against section 63 of the Consumer Protection Act] from the day it is added to your account. Credits not used by then expire.
  • Top-up credits are not refundable and cannot be exchanged for money, except where the law requires a refund (for example within the cooling-off period in section 5).
  • Top-up credits belong to your family account. They cannot be moved to another account.
  • A limit you set for one child also counts that child's use of top-up credits.

10. Failed payments

If a renewal payment fails, we will let you know and try again over [Grace period, e.g. 7 days]. If it still fails, your account moves to the free plan. No learning history is deleted.

11. Questions and complaints

Email [Contact email] with any billing question or complaint. You may also approach the National Consumer Commission or a consumer court.
